Terms of Service
These Terms govern your use of Zibe, a daily productivity and focus application operated by Artem Batutin.
Agreement to these Terms
By creating an account, signing in, or using Zibe, you agree to these Terms. If you do not agree, please do not use Zibe.
The Service
Zibe helps you organize daily routines, quick todos, focus sessions, focus notes, history summaries, and plant-based progress visuals. Zibe is a general productivity and reflection tool only. It is not medical, mental health, financial, legal, or other professional advice, and it should not be used for emergencies, crisis support, safety-critical decisions, or time-critical obligations.
No Professional, Medical, or Emergency Use
Zibe does not diagnose, treat, cure, prevent, or mitigate any disease, mental health condition, sleep condition, attention condition, or other medical condition. Zibe is not a substitute for a doctor, therapist, financial advisor, lawyer, emergency service, or other qualified professional.
If you may be experiencing a medical emergency, mental health crisis, risk of self-harm, or danger to yourself or others, do not rely on Zibe. Contact emergency services or a qualified professional immediately.
Reminders, Timers, and Productivity Cues
Any reminders, timers, streaks, cues, summaries, notifications, or similar features are provided only for convenience and personal organization. They may be delayed, inaccurate, unavailable, or not delivered at all. You are responsible for any appointments, deadlines, medication schedules, safety obligations, financial obligations, legal obligations, or other important matters, and you should not rely on Zibe as your only reminder, record, or system of control for those matters.
Accounts
You may need an account to use Zibe. You can sign in using supported methods such as Apple, Google, or email code authentication. You are responsible for keeping your account access secure and for all activity under your account.
You must provide accurate account information and may not use another person's account without permission.
Your Content
You retain ownership of content you enter into Zibe, including todos, routine names, focus notes, and related productivity records ("User Content").
You give us a limited license to store, process, display, and transmit your User Content only as needed to operate, secure, support, and improve Zibe. We do not claim ownership of your User Content.
You are responsible for your User Content and agree not to submit content that is unlawful, abusive, infringing, or harmful.
Zibe is not intended to be your only copy, archive, backup, or system of record for important or irreplaceable information. You are responsible for keeping separate copies of any User Content you need to preserve.
Acceptable Use
You agree not to:
- use Zibe for unlawful, harmful, abusive, or fraudulent activity;
- attempt to access another user's account or data;
- reverse engineer, disrupt, scrape, overload, or interfere with the Service;
- upload malicious code or attempt to compromise Zibe's systems;
- use Zibe in a way that violates applicable laws or third-party rights.
Privacy
Our Privacy Policy explains how we collect, use, store, and protect information. By using Zibe, you also agree to the Privacy Policy: https://www.zibe.app/privacy.
Account Deletion and Data
You may request deletion of your account and associated data through any in-app deletion tools we make available or by contacting zibe.app.official@gmail.com. Some information may be retained where required by law, security, fraud prevention, dispute resolution, or legitimate business records.
Third-Party Services
Zibe relies on third-party services for authentication, hosting, email delivery, app distribution, backend infrastructure, database storage, and related operations, including providers such as Apple, Google, Convex, and email service providers. Your User Content and account information may be stored or processed by those providers on our behalf.
We do not control third-party services, networks, devices, operating systems, app stores, or infrastructure providers. To the fullest extent permitted by law, Zibe is not responsible for third-party acts, omissions, outages, data loss, security incidents, policy changes, platform changes, or service limitations. Your use of third-party services may also be subject to their own terms and policies.
Fees
Zibe is currently offered without paid subscriptions or in-app purchases. If paid features are added later, we will disclose pricing and billing terms before you purchase.
Intellectual Property
Zibe, including its app design, software, branding, visuals, icons, trademarks, and related materials, is owned by us or our licensors. These Terms do not grant you any ownership rights in Zibe.
You may use Zibe only for personal, non-commercial use unless we give written permission otherwise.
App Stores
If you download Zibe from the Apple App Store or Google Play, your use is also subject to the applicable store terms. Apple and Google are not responsible for providing support or maintenance for Zibe, except as required by applicable law or their own terms.
For iOS users, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where applicable.
Availability and Changes
We may update, suspend, discontinue, limit, or change Zibe or any feature at any time, including for maintenance, security, operational, legal, provider-related, or business reasons.
We try to keep Zibe reliable, but we do not guarantee uninterrupted, secure, timely, accurate, complete, or error-free service. Some features may be experimental, incomplete, unavailable, or different across devices, operating systems, countries, accounts, or app versions.
Termination
You may stop using Zibe at any time. We may suspend or terminate access if you violate these Terms, create risk for Zibe or other users, or if required by law.
Termination does not affect provisions that should reasonably survive, including ownership, disclaimers, limitation of liability, and dispute terms.
Disclaimers
Zibe is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, availability, security, reliability, compatibility, and uninterrupted or error-free operation.
We do not guarantee that Zibe will improve productivity, focus, habits, wellness, mood, sleep, routines, finances, eating patterns, or any specific outcome. Any suggestions, summaries, categories, progress visuals, or insights are informational and may be incomplete, inaccurate, or not useful for your situation.
We do not guarantee that User Content will always be available, preserved, recoverable, or free from loss, corruption, or unauthorized access, including where issues arise from user error, device issues, network issues, third-party services, or events outside our reasonable control.
Limitation of Liability
To the fullest extent permitted by law, Zibe and its owners, employees, contractors, licensors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, or for lost profits, lost revenue, lost savings, lost data, loss of goodwill, service interruption, computer damage, device damage, security incidents, data corruption, replacement service costs, or personal, professional, business, financial, legal, medical, health, wellness, or productivity outcomes.
This limitation applies to any claim related to Zibe, these Terms, User Content, third-party services, app stores, authentication providers, backend infrastructure, notifications, reminders, timers, summaries, insights, security, privacy, data loss, service changes, suspension, discontinuation, or inability to use Zibe, whether based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to Zibe will not exceed the greater of: (a) the amount you paid to use Zibe in the 12 months before the claim, or (b) USD $100.
Some jurisdictions do not allow certain disclaimers or limitations of liability. In those jurisdictions, the limitations above apply only to the maximum extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud or other rights that applicable law does not allow you to waive.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Zibe and its owners, employees, contractors, licensors, service providers, and partners from claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from your use or misuse of Zibe, your User Content, your violation of these Terms, your violation of law or third-party rights, or your reliance on Zibe for professional, medical, emergency, safety-critical, time-critical, or other important matters.
Disputes
Before bringing a formal claim, you agree to contact us at zibe.app.official@gmail.com and give us a reasonable opportunity to resolve the issue informally, unless applicable law allows you to proceed without doing so.
To the fullest extent permitted by law, any claim related to Zibe must be brought in your individual capacity only, and not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative proceeding. To the fullest extent permitted by law, any claim must be brought within one year after it arises, or it is permanently barred.
Governing Law
These Terms are governed by applicable law, without regard to conflict of law rules, unless applicable consumer protection laws require otherwise.
Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the app, website, or email. Continued use of Zibe after changes become effective means you accept the updated Terms.
